1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Zogambo Studios LLP ("Zogambo," "we," "us," or "our") governing your access to and use of our mobile games, website at zogambo.in, and all related services (collectively, the "Services").

This document is an electronic record under the Information Technology Act, 2000 and rules thereunder. It is generated by a computer system and does not require physical or digital signatures.

These Terms must be read together with our Privacy Policy, which is incorporated herein by reference.

2. Definitions

• "Services" means our mobile games, website, and any other products or platforms operated by Zogambo Studios LLP.
• "User" / "You" / "Your" means any person accessing or using our Services, whether or not registered.
• "Virtual Items" means virtual currency, in-game coins, gems, power-ups, cosmetic item skins, or any other digital progression assets available within our games.
• "Platform" means the mobile distribution ecosystem on which our games are deployed — Apple App Store (iOS) and Google Play Store (Android).
• "Applicable Laws" means all statutes, regulations, rules, and orders of India applicable to our Services, including the IT Act, 2000 and the DPDP Act, 2023.

3. Eligibility

You are eligible to use our Services only if you meet all of the following conditions:

• You are at least 13 years of age. Users aged 13–18 must have reviewed these Terms with a parent or guardian who has consented to such use.
• You are competent to enter into a binding contract under applicable Indian law.
• Your use of the Services does not violate any Applicable Law in your jurisdiction.

By using our Services, you represent and warrant that you meet all eligibility requirements. We rely on the information you provide and shall not be liable if you or anyone using your account is ineligible or has provided false information.

4. Limited Licence to Use Our Services

Subject to your agreement with and continuing compliance with these Terms, Zogambo Studios LLP grants you a personal, non-exclusive, non-transferable, revocable, limited licence to access and use our Services solely for your own private, non-commercial entertainment purposes.

This licence does not include any right to:

• Sublicense, sell, resell, transfer, assign, or commercially exploit the Services
• Modify, adapt, translate, or create derivative works based on the Services
• Reverse engineer, decompile, or attempt to extract the source code of any part of the Services
• Use the Services in any manner not expressly permitted by these Terms

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with or without notice.

5. Prohibited Conduct & Anti-Cheating Policy

When using our Services, you agree not to:

• Use the Services for any unlawful purpose or in violation of any Applicable Law
• Use cheats, bots, hacks, automation software, memory modifiers, or unauthorised third-party tools to alter or manipulate gameplay systems
• Exploit game mechanical errors, glitches, or unintended systemic bugs to gain a structural progression advantage
• Probe, scan, or test the vulnerability of our systems or attempt to breach any security measures
• Upload or transmit content that is harmful, obscene, defamatory, hateful, or otherwise unlawful
• Impersonate any person, entity, or Zogambo employee
• Engage in any activity that could damage, overburden, or impair our servers or networks
• Collect or harvest personal information about other users from our Services
• Attempt to gain unauthorised access to any part of the Services or our internal systems
• Transmit viruses, malware, or other harmful code through the Services
• Violate the intellectual property rights of Zogambo or any third party

6. Intellectual Property

All content within our Services — including game designs, code logic, puzzle structures, level balancing architecture, artwork, graphics, animations, audio, music, text, logos, trademarks, and software code — is owned by, licensed to, or controlled by Zogambo Studios LLP and is protected by Indian and international intellectual property laws.

You are granted no ownership rights over any content. Your use of the Services does not transfer any intellectual property rights to you. You may not copy, reproduce, or create derivative works from any content without our prior express written consent.

Any feedback or suggestions you share with us regarding our Services may be used by Zogambo freely and without any obligation to compensate you.

7. In-App Purchases & Virtual Items

Some of our games may offer optional in-app purchases of Virtual Items. All purchases are processed securely by the Apple App Store or Google Play Store using your payment method on file. We do not collect or store your payment card details.

• Virtual Items have no real-world monetary value, accumulate no cash dividends, and cannot be redeemed for legal tender outside the game loop
• You purchase a limited, revocable, non-transferable licence to use Virtual Items — you do not own them
• We reserve the absolute right to manage, modify, re-balance, or discontinue Virtual Items at any time
• Virtual Items will be entirely forfeited without liability if your account is banned or terminated for violating these Terms

7a. Storefront Marketplace Terms (Apple & Google Mandates)

If you downloaded our games from the Apple App Store or Google Play Store, you explicitly acknowledge and agree to the following conditions required by the platform operators:

• Party Status: These Terms are an agreement solely between you and Zogambo Studios LLP. Apple Inc. and Google LLC are not parties to these Terms and are not responsible for the apps or their core contents.
• Maintenance & Support: Zogambo is entirely responsible for delivering any application upkeep or technical bug fixes. The platform operators have zero obligation to furnish any maintenance services for the games.
• Warranty Claims: In the event of a technical breakdown or failure to conform to any statutory warranty, you may alert the respective marketplace operator for purchase-price tracking options. To the maximum extent permitted by law, the platform operators carry no further warranty duties whatsoever.
• Product & Intellectual Property Claims: Zogambo, and not the platform operators, is responsible for addressing any claims related to the app's performance or any third-party claim that the app infringes an intellectual property right.
• Legal Compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting nation, and are not on any western government restricted list.

8. Third-Party Services & Advertising

Our games and website contain advertisements from third-party ad networks including Google AdMob, and links or integrations with third-party services. These third parties operate independently under their own terms and privacy policies.

We do not endorse, control, or assume responsibility for the content, products, or privacy practices of any third-party service. Your use of any third-party service is entirely at your own risk.

9. Disclaimers

Our Services are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied.

• We do not warrant that the Services will be uninterrupted, error-free, or free of viruses
• We do not warrant the accuracy or completeness of any content available through the Services
• We are not responsible for any loss or damage to your device arising from downloading or using our games
• Access to Services may be affected by factors outside our control, including network connectivity and third-party platform availability

10. Limitation of Liability

To the fullest extent permitted by Applicable Law, Zogambo Studios LLP and its partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Your sole remedy for dissatisfaction with any aspect of our Services is to discontinue use.

11. Indemnification

You agree to defend, indemnify, and hold harmless Zogambo Studios LLP and its partners, employees, and representatives from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use or misuse of the Services
• Your violation of any provision of these Terms
• Your violation of any third-party right, including intellectual property or privacy rights
• Any content you post, upload, or transmit through the Services
• Your violation of any Applicable Law

12. Account Suspension & Termination

We reserve the right to suspend, restrict, or permanently terminate your access to the Services at any time, with or without prior notice, in our sole discretion — including if we reasonably believe you have violated these Terms, engaged in cheating/exploiting behaviors, or breached any Applicable Law.

You may request account termination by contacting us at developer@zogambo.in. Upon termination, your licence to use the Services will immediately cease.

13. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in that policy.

14. Grievance Officer

In accordance with the Information Technology Act, 2000 and the DPDP Act, 2023, we have designated a Grievance Officer to address complaints regarding these Terms or our Services.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from these Terms shall first be attempted to be resolved amicably within 14 calendar days of written notification.

If not resolved amicably, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator mutually appointed by the parties. The language of arbitration shall be English and the seat shall be Mumbai, Maharashtra, India.

Subject to the above, the courts of Mumbai, Maharashtra, India shall have exclusive jurisdiction.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you via our website or in-app notification. Your continued use of the Services after any such changes constitutes your acceptance of the updated Terms.
